Terms and Conditions

These Terms and Conditions (“Terms”) govern the services provided by Heyworth Property Management, a property lettings and management company operating in the United Kingdom. By using our services, you agree to be bound by these Terms.

1. Definitions

  • “We”, “Us”, “Our” refers to Heyworth Property Management.

  • “Client”, “You”, “Your” refers to the landlord, property owner, or individual who instructs us to act on their behalf.

  • “Property” means the residential or commercial real estate subject to our services.

2. Scope of Services

We offer the following services, either individually or as part of a package:

  • Tenant sourcing, referencing and Tenancy set up

  • Tenancy agreement preparation

  • Routine inspections

  • Maintenance coordination

  • Legal compliance (e.g. deposit protection, safety certifications)

  • Domestic energy performance certificates

  • Property compliance services (e.g. outsourced landlord safety inspections)

A detailed breakdown of each service and associated fees is provided in our Service Agreement or Proposal.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about the property and any legal or financial matters

  • Ensure the property is compliant with UK legislation (unless otherwise agreed)

  • Maintain valid insurance for the property

  • Cooperate with us in fulfilling our duties, including granting access when needed

4. Fees and Payments

  • Fees are outlined in our pricing schedule or service agreement.

  • Payment is due within 14 days of invoice unless otherwise stated.

  • We reserve the right to deduct fees from rent received, where applicable.

  • In the event of late payment, we may charge interest at 4% above the Bank of England base rate.

5. Cancellation and Termination

  • Either party may terminate the agreement by giving 30 days' written notice, unless otherwise agreed.

  • If you terminate our services after work has commenced, fees for completed work will still apply.

  • We reserve the right to terminate services immediately in cases of abuse, non-payment, or legal non-compliance.

6. Liability

  • We will act with reasonable care and skill in delivering our services.

  • We are not liable for any loss or damage arising from events beyond our control, including tenant behaviour or third-party contractors.

  • Nothing in these Terms limits our liability for death, personal injury caused by negligence, or fraud.

7. Data Protection

We process personal data in line with the UK GDPR and the Data Protection Act 2018. For more information, see our [Privacy Policy].

8. Complaints

We take complaints seriously. If you are unhappy with our service, please contact us at [Insert Email]. We will aim to resolve the issue promptly. If unresolved, you may escalate the matter to the Property Redress Scheme or The Property Ombudsman (depending on our membership).

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
